Why I compile Pag-IBIG’s listings and add to my database

I compile listings of Pag-IBIG foreclosed properties and add to my database to make it easy to search and find your preferred property.

I do this because it is so hard to search Pag-IBIG’s website.

A friend of mine even said they should fire whoever is responsible for the changes made to their website.

But don’t take my word for it.

Go ahead, try to search for all properties in a particular barangay or village or subdivision or condo etc. on Pag-IBIG’s website and tell me your experience.

And then try searching for it here and find it in SECONDS using my database (if those properties exist and the acceptance of bids/offers have not yet ended).

However, my database does not have a crystal ball (it cannot read your mind!), YOU HAVE TO ENTER YOUR KEYWORDS TO SEARCH!!! Go ahead, type the name of your target village, subdivision, condo, barangay, etc. below and click “Search”.

Online Public Auction – Buying Foreclosed Properties Just Got Easier (Now Includes Negotiated Sale)!

Pag-IBIG has officially launched the Online Public Auction (OPA) for their foreclosed properties/acquired assets.

This means there is now a more convenient way to submit bids/offers, no need to visit their branches or send via courier.

Please take note of the updated buying procedure in the Invitation To Bid/Guidelines for each tranche.

The same online facility can also be used to submit offers for properties under negotiated sale.

However, Pag-IBIG’s website still has a lot of room for improvements.

How to participate in a Pag-IBIG Online Public Auction for acquired assets

Here’s a quick overview/summary of the buying process via Online Public Auction:

1. View the list of Pag-IBIG foreclosed properties for sale included in the auction and identify the property or properties you are interested in. Take note of the PROPERTY NUMBER.

2. Do your due diligence. When you find a property that you are interested in, you need to do a reasonable amount of due diligence (property inspection to see extent of repairs needed, check if there are any illegal occupants, checking the titles/tax declarations for any problems, etc.). Always keep in mind that foreclosed properties are for sale on an “As-is, where-is” basis.

4. Register for the Online Public Auction – Bidders are required to register online on this page (also includes requirements):

5. Submit sealed bid – As I write this, bidders can submit their bids online as follows:

  1. Go to Pag-IBIG’s official website: https://www.pagibigfundservices.com/OnlinePublicAuction/ and search for your target property. Click the “Submit Offer” button and follow instructions. Bidders can only submit bids during the duration of acceptance of bids (The “Submit Offer” button will NOT be available before/after the period of acceptance of offers)
  2. Go to Pag-IBIG’s Property Finder Page: https://www.pagibigfundservices.com/OnlinePublicAuction/ListofProperties/PropertyFinder. In the drop-down under “Search By”, choose ROPA ID and enter the PROPERTY NUMBER of your target property as listed above and click the “Search” button. You will see details of your target property with the “Submit Offer” button. Click the “Submit Offer” button and follow instructions. Bidders can only submit bids during the duration of acceptance of bids (The “Submit Offer” button will NOT be available before/after the period of acceptance of offers).

6. Opening of sealed bids shall be done as per schedule. The results of the sealed public auction shall be released and posted at Pag-IBIG’s official website. Winning bidders shall also be notified via email and SMS.

7. Winning Bidders Payment of Bid Bond – As per guidelines: “The winning bidder shall be required to pay a DOWNPAYMENT equivalent to five percent (5%) of the BID OFFER, which shall be paid within five (5) working days from the receipt of notification. It shall be in Philippine Currency and may be in the form of cash or manager’s check payable to Pag-lBIG Fund.”

How to Buy Pag-IBIG Acquired Assets for Negotiated Sale

Note: They now have a “hybrid” procedure for buying via negotiated sale. This is through online submission of bids, and also through the old manual submission process. See details below.

1. Online submission of offers now available for Pag-IBIG Foreclosed Properties For Negotiated Sale

I noticed that starting last May 2025, the latest batches for negotiated sale already has a “Hybrid” implementation.

This means interested buyers can now submit offers online (similar to how to submit bids using Pag-IBIG’s Online Public Auction), while still allowing the manual submission of offers.

For example, here’s an excerpt from Batch # 15259 Invitation to submit offer:

“Online Submission of Offers

4.1. Online submission of offers will be implemented for Retail Sale.

4.2. Interested buyers must register at the Pag-IBIG Fund website to get the Buyer ID needed to submit an offer. For those already with Buyer ID, no registration is required. The registration will require one (1) valid ID of the buyer (if individual buyer) or authorized representative (if company/corporation). The Buyer ID shall be issued three (3) working days from date of registration. Hence, registration must be done at least three (3) working days prior to the cut-off date of acceptance of offers.

4.3. From 12:00 a.m. on May 20, 2025, to 11:59 p.m. on May 24, 2025, the buyer shall enter his/her/its offer for the property at the Pag-IBIG Fund Acquired Assets page in the Pag-IBIG Fund website.

4.4. The buyer, using the Buyer ID may view the Status Tracker on Acquired Assets Webpage at the
Pag-IBIG Fund website.”

Important reminders for interested buyers

1. Pagibig does not accept reservations thru Real Estate Brokers/Agents

This was announced in Pag-IBIG’s website last September 30, 2019, and I noticed they also removed their list of accredited real estate brokers. They advice interested buyers to coordinate directly with the Acquired Asset Management Group or with the nearest Housing Hubs. Be very careful with real estate brokers/agents who are selling Pag-IBIG foreclosed properties, they are not authorized and you might end up getting scammed! Refer to the articles below for more info.

2. Pag-IBIG foreclosed properties are all for sale on an “as-is, where-is” basis

3. A big number of properties on the listings are occupied.

In summary, we do not recommend buying occupied properties, even if they can have big discounts.

Also, if you buy an occupied property, there is a risk that the occupant will cannibalize/vandalize the property, just like this one: Occupied Pag-IBIG acquired asset cannibalized/vandalized by ex-owner

4. Do your due diligence before submitting a bid/offer.

5. Check for new Erratum/Announcements.

Please refer to the notice from Pag-IBIG:

“Interested parties are encouraged to visit Pag-IBIG’s website, https://pagibigfund.gov.ph/acquiredassets.html five (5) days prior the actual opening of bid offers, to check whether there is any erratum posted on the list of properties posted under the sealed public auction/negotiated sale.”

What are Pag-IBIG Acquired Assets?

Pag-IBIG acquired assets are properties that were repossessed by Pag-IBIG because the property owner (who financed the purchase through a housing loan from Pag-IBIG) was not able to pay their monthly amortizations for at least 3 consecutive months.

Typically, non-payment would trigger the foreclosure process.

If the borrower is unable to catch-up with payments (or is unable to restructure the loan), the property will end up in a foreclosure auction that shall be conducted by the Sheriff at the City/Municipal hall where the property is located.

The lending institution (Pag-IBIG or HDMF in this case) will end up as the winner of the foreclosure auction by default if there are no other bidders, and the redemption period begins once the certificate of sale is annotated on the title.

The redemption period (1 year for individuals, 90 days for corporations) gives the borrower a chance to redeem the property, where they have to make a full payment before the redemption period ends.

If the borrower is unable to redeem the property, then the property will end up as a Pag-IBIG acquired asset or foreclosed property and they can proceed with transfer of ownership from the borrower to Pag-IBIG.

This transfer of ownership is often referred to as the “consolidation”, which can take a long time, depending on the completeness of the documents and other requirements (for example, payment of real estate taxes, etc.) needed for the transfer of ownership.

Other things to consider

Here’s one tip I want to share. If you buy a property from Pag-IBIG, and you are already authorized to move-in, make sure to move-in and take possession as soon as possible.

This will help you avoid the problem encountered by an OFW who cannot move-in to the Pag-IBIG foreclosed property they purchased.

They cannot move-in because Pag-IBIG turned over the property to another buyer. Watch the video for details.

1. How to avail Pag-IBIG acquired assets? How to buy via auction/ negotiated sale?

You can refer to the video and text summaries above. You can also read the bidding guidelines/invitation to bid for more detailed information, please download a copy from the table of schedules above (with red download buttons).

Note: Each schedule/listing of properties for auction/negotiated sale will have its own guidelines/invitation to bid, which also contains the list of properties for sale.

2. Can I get Pag-IBIG financing for Pag-IBIG foreclosed properties/acquired assets?

As a general rule, you can finance the purchase of Pag-IBIG foreclosed properties/acquired assets through a Pag-IBIG loan. This applies to buying via public auction and negotiated sale. Details are included within the guidelines for each tranche/publication batch. If you have questions, contact Pag-IBIG directly through the contact details specified in each of the listings above.

3. Where/how can I find a Pag-IBIG foreclosed property that is not on any current list/schedule?

It might be included in an upcoming schedule/listing. It’s also possible that it is not yet for sale (Ex. The property needs to be appraised, the redemption period has not yet lapsed, etc). It is also possible that it was already sold in past schedules. Please call Pag-IBIG directly to inquire. I highly suggest that you call the designated contact person(s) in other listings/schedules for the same location of the property/ies you are interested in.

4. Can you help us find Pag-IBIG foreclosed properties within my preferred location/city/village/budget, etc?

We can no longer give assistance as brokers because Pag-IBIG no longer allows brokers/agents to sell their properties effective September 30, 2019.

However, I created a tool so you can find properties easily and “Do It Yourself”.

You can search our foreclosed properties database where you can quickly find properties in your preferred location (search for the city, subdivision, village, condo name, etc). You can even filter to only include properties withing your target price-range/budget, and also exclude properties that have illegal occupants as indicated in the listings from Pag-IBIG.

5. What does it mean if a Pag-IBIG acquired asset is “OCCUPIED”?

An “Occupied” status/remark means the foreclosed property has illegal occupants, and the buyer will have to eject the occupants. We also received feedback that some properties that are listed as unoccupied can turn out to be occupied.

2. How to avoid foreclosed properties that are tagged as “occupied” – This is now easy with our “Foreclosed Properties Database”. Here’s a step-by-step on how to do this: How To Exclude Occupied Foreclosed Properties When Searching Our Foreclosed Real Estate Database

If you find out that a property is occupied, my advice is to forget about that property and move-on to other available properties that are not occupied.

6. Who do I contact to inquire for Pag-IBIG foreclosed properties?

Please contact Pag-IBIG directly through their designated contact person(s) for each schedule/listing of properties for public auction/negotiated sale. The contact person(s)/contact details can be found inside the listing/bidding guidelines above, and also within the details for properties inside our database.

7. Can I buy Pag-IBIG foreclosed properties that were not sold during a previously scheduled public auction/negotiated sale?

Yes you may, but you have to check if a property is really still available and was not sold during a previous schedule (you have to contact Pag-IBIG directly to check). To give you an idea, here’s what can happen to properties that are not sold (This is based on Pag-IBIG circular 428):

1. If a property is not sold sold during the 1st auction, it will be included in a 2nd auction (you have to check each new schedule/listing to see if your target property is included).

2. If a property is not sold during the 2nd auction, it will be included in another schedule/list of properties under negotiated sale.

3. If a property is not sold under a schedule/listing via negotiated sale, it will be included in another schedule/listing of properties under negotiated sale. They repeat this until it a property gets sold.

8. Can I sell Pag-IBIG foreclosed properties as a real estate broker/sales person?

No, Pag-IBIG no longer allows accredited licensed real estate brokers to sell their foreclosed properties as announced on their official website last September 30, 2019. Details are explained here: Real Estate Brokers/Salesperson are not allowed to sell Pag-IBIG properties

9. Can you please check if a Pag-IBIG foreclosed property from an old list/schedule is still available?

Only Pag-IBIG has information if a property is still available and was not sold in previous listings/schedules of auctions and negotiated sale. Please contact Pag-IBIG directly to check if a property from an old listing/schedule is still available. I highly suggest that you call the designated contact person as indicated in the old schedule/listing.

10. What are the requirements to buy Pag-IBIG foreclosed properties?

To get a complete list of requirements, please refer to the guidelines which you can download above (those in red buttons).

11. We live in a property that is now a Pag-IBIG acquired asset/foreclosed property, can we buy it/apply for it?

Pag-IBIG can give occupants of their acquired assets a chance to purchase the property. They call this a “Direct Purchase”.

With Pag-IBIG’s Online Public Auction portal, occupants can actually submit bids for the property they occupy. See screenshot.

Here are the details as quoted from Pag-IBIG circular 428:

IV. DIRECT PURCHASE FOR OCCUPIED UNITS

1. Direct Purchase shall refer to the purchase of the acquired assets by the present occupant.

2. The Fund shall issue an Invitation to Purchase (ITP) to the present occupant offering him/her the option to purchase outright the acquired asset or to lease the property with option to purchase later.

3. The present occupant shall submit an Offer to Purchase (OTP) indicating his chosen mode of payment, and pay the non-refundable reservation fee. Said reservation fee shall be forfeited in favor of the Fund in case the buyer did not pursue the sale transaction, or his application is denied for reasons attributable to him. The OTP shall be valid for a period of thirty (30) calendar days.

4. The selling price of the subject acquired asset shall be based on its latest appraised value.

5. No discount shall be granted under direct purchase.

6. Once an offer has been made, the buyer must comply with the terms and conditions of the chosen mode of payment under Item VI.1 of this Guidelines within the prescribed period from payment of the reservation fee.

7. If the occupant fails to submit an OTP within the prescribed period from receipt of the Invitation to Purchase, Pag-lBIG Fund may initiate the eviction proceedings.”

12. What does it mean if Pag-IBIG acquired asset’s title is “FOR CONSOLIDATION”?

When a Pag-IBIG foreclosed property’s title (TCT/CCT) is “FOR CONSOLIDATION”, it means it is still under the name of the former owner/original borrower and Pag-IBIG has not yet finished the transfer of the title to them.

The process of transferring the title of a foreclosed property/acquired asset to Pag-IBIG is called “CONSOLIDATION” and it can take a long time depending on the completeness of the documents required for the transfer of the title.

13. What is the difference between Pag-IBIG ACQUIRED ASSETS and FORECLOSED PROPERTIES?

PAG-IBIG ACQUIRED ASSETS and FORECLOSED PROPERTIES are the same. These properties are also referred to as ROPA (Real and Other Properties Acquired). They can also be referred to as pagibigfund acquired assets

14. What does “TCT under abatement” mean? Is it safe to buy?

The BIR has an “Abatement Program” where the taxpayer (HDMF in this case) can apply for the reduction or cancellation of taxes, penalties, and/or interest. This process can take a long time and will affect the consolidation of the title. This is the reason for the following disclosure in the affected listings:

“TCT UNDER DEVELOPER OR UNDER ABATEMENT MAY TAKE SEVERAL YEARS (MORE OR LESS 5 YEARS) FOR TCT TO BE CONSOLIDATED IN THE NAME OF THE FUND”

Since the consolidation of the title will take a long time, this can make it difficult to transfer the ownership if you decide to sell the property. To avoid complications with title transfer to your buyer, you will have to wait for the title consolidation to finish.

15. The Pag-IBIG listing on their website now has a status “Problematic Property” or “Reason for Erratum: For Further Verification”. Why can’t I submit a bid/offer?

When a Pag-IBIG property on their official website is updated with a status like these, it means the property has an issue and it is not available until the issue is resolved. In the past, I noticed the following issues as reason for erratum:

– an error in the listing (wrong address or data)
– property excluded due to invalidity of lapsed appraisal
– property excluded because they will issue an Invitation To Purchase (ITP) to current occupant (Direct Purchase)
– property excluded because it was already sold prior to publication of tranche/batch
– property exclusion due to direct purchase of current occupant prior to auction
– exclusion due to property found to be occupied
– exclusion for proper validation
– reserved by third party prior to auction
– included in settlement plan of developer
– w/ pending or ongoing legal case
– condemned unit
– w/ settlement plan with the previous borrower

  2. Hi, paano po kung foreclosed na un bahay. Matagal na walang communication kay PAG-IBIG tapos, just this January, may pumuntang taga PAG-IBIG at kinuhaan ng mga picture ang bahay. ibig sabihin po ba nun, kasama na sa ibibenta un unit?

Hi Mr. Jay, tanong ko lang po, kung may foreclosed property po sa Pag-ibig na gusto naming bilhin, pwede po ba kaming directly magrequest ng copy ng title from Register of Deeds as part of due diligence, o kailangan pa po ba ng permission from Pag-ibig? And regarding the bid price, advisable po ba na magstick na ko sa minimum bid price, if not, ano po ang pwedeng gawing basis kung ilang percent ang idadagdag ko sa minimum bid price? Thanks po.

    1. Hi Marie, regarding sa title, pakicheck yung answer ko dun sa other question mo, thanks.

      Pagdating sa bid, pwede ka lang mag stick sa bid price kung walang kalaban pero mahirap malaman yon pag sealed bidding. Pwede na siguro dagdagan mo lang ng konti (around 5%) unless gustong gusto mo yung property (pwede mo pang taasan.

      Kung balak mo mag buy and sell, compute mo muna siyempre kung ano ang pwede mong idagdag pero kikitain mo pa rin yung target profit mo.

    1. Hi Neil, since “as-is, where is” basis po ang bentahan, yung buyer na ang bahala sa pagpapaalis. Depende napo sa buyer kung relocation ang gagawin niya, pero sagot na niya lahat ng gastos.

      Suggestion ko po, iwas na lang sa occupied properties.

    1. Hi Ms. Evelyn, based po sa guidelines, pwede lang po kayo magsubmit on the day of the auction.

      Regarding discounts, depende po sa listing kung may available discounts.

      Yung sa downpayment, depende po pag na-approve yung loan niyo for the 90%, so pag a-approve po yung housing loan niyo sa 90%, yung 10% napo ang downpayment niyo. Good luck po!

    1. Dapat po may resulta agad, nakalagay kasi sa bidding guidelines na opening of bids will follow immediately after the deadline of submission.

        1. Bale pag “occupied” ibig sabihin may nakatira po dun sa property na pwedeng former owner or illegal occupant. Buyer na po ang magpapa-eject.

          “Negotiated sale” – Ibig sabihin po hindi na dadaan ng auction, mag submit na lang po kayo ng offer sa Pag-IBIG based on their standard procedure.

          “Title for consolidation” – Ongoing po ang paglipat ng titulo dahil nakapangalan pa po sa former owner, ongoing ang paglipat sa pangalan ng Pag-IBIG.

          Nabalitaan ko din po na pwede na ang 3 family members as co-borrowers, pero paki tanong po sa Pag-IBIG ang details or attend po kayo ng seminar nila for member na mag-a-apply for a housing loan.

      2. sir nakita ko na po sa link yung property na gusto ko Kaya lang may remarks sya na ganito, “OCCUPIED AVAILABLE – NEGOTIATED SALE FOR TITLE CONSOLIDATION”, ano po ang ibig sabihin nun, available pa po ba sya o may nakakuha na, at totoo po ba na pwedi na po ang 3members sa pagibig kung kukuha ng house and lot, balak kasi naming mag asawa na isama ang hipag ko para makuha namin yung lot medyo malaki rin po kasi ang TCP nya, sana po ay matulungan nyo ako, salamat po.

    1. Check niyo po muna kung sino may-ari, punta kayo sa city assessors office na nakakasakop sa property, sa tax-mapping section. Sabihin niyo gusto niyo mag due diligence sa isang property, tapos bigay niyo address. Sasabihin nila kung sino may-ari based on the tax declaration, pati na rin title number. Tapos punta kayo sa registry of deeds para makita kung sino may-ari based sa title, at kung kanino naka-mortgage (kung totoo nga na naka mortgage). Kung sa Pag-IBIG nga naka mortgage, pwede niyo check, tawag kayosa Pag-IBIG.

    1. Bale kayo po yung naca-occupy? Try niyo rin po kahit hindi kayo yung former owner. Malay natin pumayag yung nauna magapply na tanggapin yung pera nila pag binalik niyo. Yun nga lang, hindi pa rin sigurado kung i-a-allow kayo ng Pag-IBIG, so tanong niyo na rin po para sure.

        1. Sa pagkakaintindi ko po nung last time nagbigay ng orientation ang Pag-IBIG sa brokers, binibigyan naman nila ng chance na makabili yung current occupant. Hindi ko lang po sure kung ano ang procedure, kaya ang suggestion ko po paki check sa Pag-IBIG directly.

          Regarding kung makipagtigasan, kung ako po ang tatanungin ay mas maganda na try niyo muna makipag-usap ng mahinahon sa kanila at pati na rin sa Pag-IBIG, tapos banggitin niyo na na pinaayos niyo na ang bahay, yung sa tubig, kuryente, etc.

    1. “Rent to own” po ba yan? Pwede niyo po sabihin sa Pag-IBIG, pero malamang sabihin nila na labas sila sa usapan niyo (kayo at ang may-ari), at ang kausap lang ng Pag-IBIG ay yung may-ari na nag loan sa kanila. Medyo dehado po kayo.

      Pero itanong niyo na rin sa Pag-IBIG kung ano status nung property, baka naman po nag ne-negotiate yung may-ari.

      Worst case eh baka po malapit nang ma-foreclose, or naforeclose na po yung bahay. Pag ganun eh lugi po kayo kasi baka hindi napo mabalik sa inyo yung binabayad niyo sa may-ari.

Once a property has been foreclosed by a bank/lender and property ownership has been transferred to thr bank/lender after the redemption period, then the bank/lender has already “acquired” the property, and is already part of their acquired assets or foreclosed property inventory.

    Here’s my situation. Currently po we’re occupying a foreclosed property which is first owned po ng tita ko but unfortunately it was foreclosed 3yrs ago. Gusto po nmin bilin or iassume ung balance so we went to pagibig to inquire. Sabi po ng pagibig that we have to wait until for bidding n ung property, but its almost a year na po pero ndi p din po saya for bidding. We went back to pagibig to check pero same p din po ung sinasabi nila. Any advise po kung ano pede nmin gawin. I know we are consider as illegal occupant pero until now kahit invitation to purchase wala po kasi sila binibigay 🙁

    1. Hi Mr. Norberto, they might be waiting for the redemption period to lapse. There might have been a delay with the annotation of the certificate of sale, causing a delay in the start of the redemption period. Suggestion ko po clarify niyo kung kelan matatapos yung redemption period para may idea kayo kung kelan lalabas or ma-include yung property sa mga invitation to bid na nirerelease ni Pag-IBIG.

Suggestion ko po, dumiretso kayo sa Pag-IBIG head office (yung sa Jelp building, Shaw Blvd. Mandaluyong City) para makipagusap directly kung ano status ng property. Magdala din po kayo ng letter na nag e-explain kung ano po nangyari kaya hindi kayo nakapagbayad, pati na rin po yung hospital bills. Kahit hindi sigurado, baka po mapagbigyan dahil sa nangyari, wala naman pong mawawala kung subukan.

      Sa pagkakaintindi ko po, hindi pa po tapos ang redemption period, tama po ba? Kung within redemption period, eh di kayo pa rin po ang rightful owner. Same process lang po pag nag evict ng tenant, ipabarangay niyo po muna. Baka po dun pa lang maayos na.

    1. Grabe naman po yung kwento niyo, pero at least kilala niyo yung nag-occupy ng bahay niyo.

      Regarding naman po sa property niyo, nakalagay po sa billing statement ng Pag-IBIG na “You shall be considered in default if you fail to pay three (3) consecutive monthly installments/amortizations and/or monthly membership savings and other obligations under the loan. Default will lead to cancellation of your CTS or FORECLOSURE of your mortgage.”, kaya po naging acuired asset yung property niyo, lalu na at 2 years po palang hindi kayo nakapag hulog.

      Suggestion ko po contact niyo agad ang Pag-IBIG para malaman kung talagang sold na yung property niyo or hindi pa para malaman kung pwede pang mahabol. Sana nga po pwede pa, sayang naman at 75K na lang po pala ang balance niyo.

    1. Suggestion ko po, hingi kayo ng statement of account sa owner, pati na rin authorization para ma verify niyo yon sa Pag-IBIG.

      Kung formal assumption of mortgage, dapat po ma-approve kayo ng Pag-IBIG. Sa tingin ko po kailangan niyo parehong makauwi dito sa Pilipinas para maayos lahat, at si Pag-IBIG po ang magsasabi kung paano ang buong proseso.

      Kung internal agreement niyo lang po with the owner, hindi alam ni Pag-IBIG na may usapan kayo nung owner, at pwedeng ituloy niyo na lang ang bayad, pero si owner pa ring ang nakaharap sa Pag-IBIG. Pwedeng gumawa kayo ng kasulatan or SPA na pag fully paid na eh kayo na ang kukuha ng titulo sa Pag-IBIG at pwede niyo na ilipat yung ownership sa inyo. Ingat lang po kasi halos wala kayong pinanghahawakan (papel lang), tapos hindi niyo naman talaga kilala yung owner.

Assuming na naideal na yung Unit ng seller at buyer at na-iverify ko na sya talaga yung may -ari or shall we say sa bibilin mo sa kamag anak yung Unit, If may SPA na at na ituloy ko na yung monthly at full payment na. SPA ang pang laban ko sa korte sakaling ayaw nilang ibigay yung title? Please help sa Gray area. Thanks.

            1. As long as genuine yung SPA, yes po. Mas maganda po magconsulta na din kayo sa abogado para yung contrata niyo ay mas kumpleto ang wording at mas protektado kayo.

We are eyeeing a foreclose property in Pagibig at for bidding n sya for september..ang problema ma po pagpunta nmn sa H&L my occupant ito pero hinid sya ung previous owner ng bahay..sabi ng mga kapitbahay nabili nya n raw ung “rights”. When we checked at the RD ung title po ay may annotation n certificat of sale sa HDMF*(Pagibig)…gsuto po nmkin bihilin ung properties pero bka hinid umalis ung occupant at may laban b sya pgngkaton sa sinsabi nya n nbili nyang rights s dting owner? tumira lng sila ddun cgurto mga march or april this year..pero ung title ay nka certificate of sale pa last aug 2015..natatakot po kmi bka mwalan ng saysay ung pagbili nmin ng bahay kasi sa nabsa ko duiot sa link na to:

    1. Hi RJ, as I often mention here, whenever you see an occupied property, just walk away and move on to the next property. It’s not worth your time, money, and effort, not to mention loss of peace of mind and many sleepless nights.

      The illegal occupant may or may not have a legal agreement with the former owner, but that’s worthless because Pag-ibig foreclosed the property anyway, which is his problem, not yours, unless you buy it. Please don’t.

        1. Hi RJ, may laban sila in a way kasi hawak nila yung property, pero siyempre kayo ang nasa katwiran. Kung ako po ang nasa lugar niyo, iwas na lang po.

We are really interested with the property..and we also understand the consequence na pede pong umabot sa court ung gnitong kaso..willing nmn kming antayin ung 1 or more than a year n paglakad ng kaso..basta malaman nmin n kmi ung nsa katwiran..we will just take it n ung ggastusin sa court ay part ng nadiscount ni pagibg sa bahay(base po sa experience nyo the usual po ba lalampas po kaya ng 150K?)..ngpunta po kami sa pagibig at sabi buyer’s in good faith daw kami pagngkataon kasi sila nang ngbebenta ng bahay n clean title..ang tanong ko lang po..sila po ba (ung ng occupant ng haus /2nd owner) masasabing Buyer’s in god faith sila kung binentahan sila ng mayari ng rights pero nacquired n ni pagibg? Salamat po ng marami..

            1. Honestly, hindi pa kami nagkaroon ng propery na may kaso kasi umiiwas kami (kahit abogado misis ko), kaya hindi ko masasabi kung magkano gagastusin niyo.

              In my opinion, pareho kayong hindi buyer in good faith kasi pareho niyong alam na may issues yung property (yung occupant – alam nila na naforeclose na yan ng Pag-IBIG… kayo naman – alam niyong may illegal occupant).

                May nabasa po kasi ako sa isang kaso..na para mging in good faith ka sa “Registered” title ang pagbabasehan mo..which sa casse po anmin chincke po nmin sa RD at nkita nmin n nkcert of sale n nga sa pgibg sa annotation ng title ung property last 2014 pa natapos. eto po…

                In Cabuhat v. Court of Appeals, we said that it is well-settled that even if the procurement of a certificate of title was tainted with fraud and misrepresentation, such defective title may be the source of a completely legal and valid title in the hands of an innocent purchaser for value. Thus

                Where innocent third persons, relying on the correctness of the certificate of title thus issued, acquire rights over the property the court cannot disregard such rights and order the total cancellation of the certificate. The effect of such an outright cancellation would be to impair public confidence in the certificate of title, for everyone dealing with property registered under the Torrens system would have to inquire in every instance whether the title has been regularly or irregularly issued. This is contrary to the evident purpose of the law. Every person dealing with registered land may safely rely on the correctness of the certificate of title issued therefor and the law will in no way oblige him to go behind the certificate to determine the condition of the property.
                Hope this means we can consider ourselves as buyer in good faith as we have checked and rely on the correctness of TCT on RD office.

                1. You’re welcome RJ., and thanks for sharing the details of that case. I suppose that’s the legal definition of a buyer in good faith.

                  Mine is more of how sellers look at it.

                  For example, if the bank says “Check niyo po muna yung property, huwag niyo bilin pag may problem kasi “as-is, where-is” po tayo”. Tapos sinabi ni buyer na “wala namang problema, hindi siya occupied, walang kaso, at walang problema sa title”. Yon ang buyer in good faith para sa kanila kasi nag due diligence naman sila ng maayos at walang nakitang problema, kay nila binili.
                  In contrast, pag si buyer eh sinabi “May problema yung title pero bibilhin ko pa rin…”. Most banks would say something like “Okay po, pero tandaan niyo na as-is where is po tayo. Huwag po kayo mag reklamo later…”. Kasi nga pag nagreklamo ang buyer later, baka sabihin ni bank “Eh alam niyo naman na may problem eh…”. So parang hindi in good faith and tingin nila doon sa example ko.

                  Anyway, tama po, timbangin niyo po ng mabuti bago kayo mag decide. Good luck RJ.

Kc hndi na nila nahuhulugan un at walang kiryente kc gumawa cla ng illegal kya tinanggal ng meralco.they need to pay for the penalty.pano ko po mabibili kung cla ang signatory and wala daw sila balak ipagbili?         1. Kung ako po ang tatanungin, iwas na lang po pag occupied ang isang property, marami naman pong iba diyan. Sakit sa ulo po pag tinuloy niyo ang pagbili, kaya mabuti na po ang umiwas.

Sorry po, hindi ko na kayang sagutin kayo isa-isa… bale i-u-update ko po yung listahan sa taas para kita agad lahat ng Province, Cities/Municipalities ang included per auction, tapos download niyo na lang para ma-check.
